1. Acceptance of Terms
By accessing or using GNLinks ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a binding legal agreement between you ("User") and GNLinks ("we", "us", or "our"). We reserve the right to update these Terms at any time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance.
2. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must immediately notify us at himanshu.mishra@thehigherpitch.com of any unauthorised use of your account. We recommend enabling two-factor authentication (2FA) for additional security. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. Accounts may not be transferred without written consent from us.
3. Acceptable Use Policy
You agree NOT to use the Service to: - Shorten or redirect to URLs containing malware, phishing, illegal content, or content that violates the rights of third parties. - Distribute spam or unsolicited commercial messages. - Circumvent, bypass, or interfere with the security features of the Service. - Scrape, crawl, or systematically extract data from the Service. - Create links to content that is defamatory, obscene, harassing, or otherwise unlawful. - Use the Service in a manner that violates any applicable local, national, or international law or regulation. - Impersonate any person or entity or misrepresent your affiliation. - Use automated tools to create accounts or links at a rate that degrades service quality. We reserve the right to suspend or terminate accounts that violate this policy without notice.
4. Intellectual Property
The Service, including all software, design, trademarks, and content produced by us, is owned by GNLinks and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You retain ownership of all content (URLs, link titles, campaign names) you input into the Service. By using the Service, you grant us a limited licence to process and display that content solely to provide the Service to you.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully to understand our practices. In summary: we do not store raw IP addresses, we do not sell your data, and we provide GDPR-compliant data export and erasure tools. See our Privacy Policy at /privacy for full details.
6. Subscriptions and Billing
Some features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All payments are processed by Razorpay. By providing payment details, you authorise us to charge your payment method for the subscription fee. Refunds: Subscription fees are non-refundable except where required by applicable law. If you cancel, your access continues until the end of the current billing period. Price Changes: We will provide at least 30 days' notice before changing subscription prices. Continued use after the notice period constitutes acceptance of the new price. Free Tier: We reserve the right to modify or discontinue the free tier at any time with reasonable notice.
7. Termination
You may terminate your account at any time via Settings > Privacy > Delete Account. Upon termination, your data will be queued for deletion subject to our retention policy (30-day grace period for account recovery). We may suspend or terminate your access immediately, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. We will endeavour to provide notice where practicable. Termination does not relieve you of obligations incurred prior to termination.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GNLINKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in [City, India].
